TERMS OF SERVICE — SIMPLYWOODPLAN APP

IMPORTANT NOTICE FOR NON-FRENCH SPEAKERS
Simplywoodplan is a service operated from France by a French sole proprietorship and governed by French law. The service is primarily intended for users located in France and the European Union. Users from other jurisdictions, including the United States, are welcome to subscribe, but acknowledge that the structural calculations integrated into Simplywoodplan are based on European standards (Eurocode 5 / EN 1995). Users outside of Europe are solely responsible for verifying compliance with their local building codes, regulations, and permitting requirements before applying any generated plan to a real-world construction project. By subscribing, you agree that French law governs this contract.
ARTICLE 1 — PURPOSE AND ACCEPTANCE
These Terms of Service (hereinafter "Terms") govern the contractual relationship between Michel Guiot, operating as a sole proprietor in France (hereinafter "Simplywoodplan" or the "Publisher"), and any individual or legal entity subscribing to the Simplywoodplan service (hereinafter the "User").
Any subscription to the service constitutes full and unconditional acceptance of these Terms. The User acknowledges having read and accepted them prior to completing the payment.
The Publisher reserves the right to modify these Terms at any time. The Terms applicable to a given subscription are those in effect on the date of subscription.

ARTICLE 3 — DESCRIPTION OF THE SERVICE
Simplywoodplan is an online design tool for wooden structures (pergolas and similar outdoor structures). After signing up, users gain access to a web application that allows them to enter the dimensions and parameters of their project, select a model from those available, and generate a comprehensive PDF plan that includes construction drawings, structural sizing of wood sections, verification of strength and deflection, and a hardware list.
The structural calculations included in Simplywoodplan comply with Eurocode 5 (EN 1995) and have been validated by our partner, the wood structural engineering firm Egitura Conception
The service includes the generation of up to fifty (50) PDF plans per calendar month. The counter resets at the start of each new month.
ARTICLE 4 — PRICING AND PAYMENT TERMS
The subscription fee is €29 (Euros) per month, including taxes.
VAT is not applicable under Article 293 B of the French General Tax Code (French small-business VAT exemption scheme).
Payment is processed exclusively by credit or debit card through the secure Stripe platform. Simplywoodplan does not store or access any payment data; only Stripe processes and retains such data in compliance with PCI-DSS standards.
A compliant invoice is issued for each payment and made available to the User via email or through the customer portal. If the User does not receive the invoice automatically, they may request it at any time by emailing simplywoodplan@gmail.com.
ARTICLE 5 — SUBSCRIPTION AND ACCESS
Subscription is initiated at https://www.simplywoodplan.com according to the following process: selection of the subscription plan, entry of the User’s email address and payment information, express acceptance of these Terms, and—for consumer Users (non-professionals)—express acknowledgment of the waiver of the right of withdrawal as described in Article 7. Payment validation completes the subscription.
Access to the service is granted immediately upon confirmation of payment, by sending a login link to the user's email address. Authentication is performed using a magic link or a one-time code (PIN).
The User agrees to provide a valid email address and to keep their login credentials confidential. Any use of the account is deemed to have been made by the account holder.
ARTICLE 6 — TERM, RENEWAL, AND TERMINATION
The subscription is entered into on a monthly basis and is automatically renewed on each due date, in accordance with Article L215-1 of the French Consumer Code.
The User may cancel their subscription at any time, free of charge and without providing a reason, through the Stripe customer portal, which can be accessed via the "Manage my subscription" link on the website.
Termination takes effect at the end of the current billing cycle. The User retains access to the service until the end of the billing cycle for which payment has already been made. No new charges will be processed after termination, and no refund will be issued for the unused portion of the current month.
The Publisher reserves the right to suspend or terminate any User account in the event of a material breach of these Terms, including but not limited to fraudulent use, attempts to circumvent technical limitations, or infringement of intellectual property rights. Such suspension or termination may occur without prior notice and without refund.
ARTICLE 7 — RIGHT OF WITHDRAWAL AND EXPRESS WAIVER
For Users who qualify as consumers under French consumer law (individual, non-professional Users), a fourteen (14)-day right of withdrawal generally applies from the date of subscription, pursuant to Article L221-18 of the French Consumer Code.
However, by checking the designated box during the subscription process, the User, as a consumer, expressly acknowledges: their request for immediate performance of the service upon confirmation of payment; their express waiver of the right of withdrawal in accordance with Article L221-28-1° of the French Consumer Code; and their understanding that, once the service has been fully and immediately performed, no right of withdrawal may subsequently be exercised.
This express waiver is retained by the Publisher as evidence of the User's consent.
For users who qualify as professionals, the right of withdrawal provided for under French consumer law does not apply, in accordance with Article L221-3.
ARTICLE 8 — INTELLECTUAL PROPERTY
All elements comprising the Simplywoodplan service—the application, calculation engine, models, interface, text, images, visual identity, and algorithms—are the exclusive property of Michel Guiot and are protected under the French Intellectual Property Code and international copyright treaties.
Any reproduction, display, modification, publication, transmission, or alteration, in whole or in part, of the service or any of its components, by any means whatsoever, is strictly prohibited without the prior written consent of the Publisher.
PDF plans generated by the User as part of their subscription may be freely used by the User for personal or professional purposes (construction of the corresponding structures, presentation to clients, archiving). However, their resale, commercial distribution, or integration into any competing service is strictly prohibited.
The User agrees not to attempt to extract, copy, or reproduce the calculation engine, standard cross-sections, design tables, or any other technical data underlying the service.
ARTICLE 9 — LIMITATION OF LIABILITY
The structural calculations included in Simplywoodplan comply with Eurocode 5 (EN 1995) and have been validated by our partner timber structural engineering firm, Egitura Conception
However, Simplywoodplan does not replace a project-specific structural analysis performed by a qualified professional on site. The User acknowledges that the generated PDF plan is a design-assistance document, and that final implementation—including verification of actual site conditions (timber quality, anchoring, soil conditions, local climatic loads, surroundings)—remains the User’s sole responsibility.
The Publisher shall not be held liable for any direct or indirect damages resulting from: implementation that does not comply with industry standards and best practices; misinterpretation of the provided plan; failure to obtain required administrative authorizations (building permits, prior notices of work, local zoning regulations); or use of the plan in a context not anticipated by the service (non-standard seismic zone, exceptional snow loads not accounted for, etc.).
The Publisher shall not be held liable for temporary service interruptions resulting from maintenance operations, failures of third-party services (Glide, Stripe), or acts of God.
In any event, the Publisher’s liability, if any, shall be limited to the total amount actually paid by the User during the twelve (12) months preceding the event giving rise to the damage.
ARTICLE 10 — PERSONAL DATA
The processing of the User's personal data is governed by the Privacy Policy, which is available on the website and forms an integral part of these Terms.
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, users have the right to access, correct, delete, transfer, and object to the processing of their personal data, which they may exercise at any time by writing to simplywoodplan@gmail.com.
ARTICLE 11 — CUSTOMER SERVICE AND COMPLAINTS

The Publisher agrees to respond within a reasonable timeframe, and no later than seven (7) business days after receiving the request.
For Users who qualify as consumers under Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute that has not been resolved directly with the Publisher, the User may submit the dispute, free of charge, to the following consumer mediation service:

ARTICLE 12 — GOVERNING LAW AND JURISDICTION
These Terms are governed by French law.
In the event of a dispute, and following an attempt to resolve it amicably, the competent court shall be the court of the defendant’s domicile for Users who qualify as consumers, and the court within the jurisdiction of the Publisher’s place of business (Coutances Court, France) for Users who qualify as professionals.
Users located outside of France acknowledge and agree that this contract is governed by French law and that the French courts have jurisdiction in accordance with the rules set forth above, subject to any mandatory consumer protection provisions in their country of residence.
